When Construction Falls Lead to Injury

Falls on construction sites happen fast. One moment a worker is doing their job, and the next they’re facing broken bones, spinal damage, or worse. In Ventura County, these incidents are more common than most people realize.
A Recent Fall in Simi Valley
In September 2025, a construction worker was seriously injured after falling roughly 15 feet while working inside a large water tank under construction in Simi Valley. Ventura County firefighters had to use a ladder truck to lower a basket into the tank to bring the man out. He was transported to a hospital in serious but stable condition, according to a report from KCLU.
Incidents like this aren’t isolated. They reflect a pattern that plays out on job sites across California every year.
Why Falls Are the Biggest Threat on Job Sites
Falls from elevation remain the leading cause of death in the construction industry. According to OSHA’s Fall Prevention Campaign, there were 389 fatal falls out of 1,034 total construction fatalities recorded in 2024. That’s more than one out of every three construction deaths caused by a fall.
The most common scenarios include:
- Falls from scaffolding, ladders, or rooftops
- Falls into open tanks, pits, or excavation sites
- Falls through unprotected floor openings or skylights
- Falls from elevated platforms or structural steel
And the nonfatal numbers are staggering too. Tens of thousands of construction workers end up in emergency rooms each year because of fall-related injuries on the job.
What OSHA Requires From Employers
Federal law places the responsibility for fall prevention squarely on employers. OSHA’s fall protection standard, 29 CFR 1926.501, requires employers to provide fall protection systems for workers at heights of six feet or more on construction sites. This includes guardrails, safety nets, personal fall arrest systems, or other approved methods.
Fall protection has been OSHA’s most frequently cited violation for over a decade. When an employer fails to provide the required protections and a worker gets hurt, that failure can become a significant factor in any legal claim that follows.
Beyond Workers’ Compensation
Most injured construction workers file a workers’ comp claim, and that’s an important step. But workers’ comp has limits. It covers medical treatment and a portion of lost wages, but it doesn’t compensate for pain and suffering. It also doesn’t hold anyone accountable for negligence.
In many Ventura construction accident cases, a third-party liability claim may be available. That means the injured worker can pursue a separate lawsuit against parties other than their direct employer, such as:
- A general contractor who controlled site safety
- A property owner who failed to address known hazards
- A subcontractor whose negligence contributed to the fall
- A manufacturer of defective safety equipment
These claims can recover compensation that workers’ comp simply doesn’t provide, including full lost income, future earning capacity, and damages for the physical and emotional toll of the injury.
What Injured Workers Should Know
If you’ve been hurt in a fall on a construction site, there are a few things worth keeping in mind. First, report the injury and seek medical attention immediately. Second, don’t assume workers’ compensation is your only option. Third, the timeline for filing a third-party claim is governed by California’s statute of limitations, so waiting too long can cost you your right to recover.
Cohen Injury Law Group works with construction workers throughout Southern California who’ve been seriously injured on the job, including cases involving falls from elevation, scaffolding failures, and unsafe working conditions.
